These Terms of Service (“Terms”) govern your use of spinandsell.com and purchases made through our Shopify store operated by BJSD Solutions, LLC dba Spin and Sell (“Spin & Sell,” “we,” “us,” or “our”).

By accessing the site or placing an order, you agree to these Terms. If you do not agree, do not use the site.

Purchases on eBay are also subject to eBay’s user agreement and the terms on each listing.

1. Eligibility

You must be able to form a binding contract in your jurisdiction and provide accurate order information. You are responsible for maintaining the confidentiality of your account credentials if you create an account.

2. Products and descriptions

We try to describe products accurately, including condition notes for used, collectible, or media items. Colors and appearance may vary due to screen settings and photography.

Collectibles and media (including vinyl, CDs, posters, stickers, and similar goods) may be new, used, or open-box as stated on the product page. Please read titles, descriptions, and photos carefully before buying.

We reserve the right to limit quantities, refuse orders, or correct pricing or description errors, including after an order is submitted.

3. Pricing and payment

Prices are shown in U.S. dollars unless otherwise stated and may change without notice. Taxes and shipping are calculated at checkout.

Payment is processed through Shopify and its payment partners. You represent that you are authorized to use the payment method you provide.

4. Orders and fulfillment

Order confirmation does not guarantee acceptance. We may cancel an order for suspected fraud, inventory errors, pricing errors, or supplier unavailability.

Some products are fulfilled by third-party suppliers (including via Shopify Collective). Those suppliers ship directly to you. Title and risk of loss pass according to our Shipping Policy and applicable law.

5. Shipping and returns

Shipping, delivery estimates, returns, and refunds are described in our Shipping policy and Return and refund policy. Those policies are part of these Terms.

6. Dual sales channels

We sell through spinandsell.com and through our eBay store. Inventory may appear on both channels. Availability is not guaranteed until checkout completes (on Shopify) or a purchase is completed on eBay.

Checkout for eBay listings occurs on eBay. Checkout for spinandsell.com occurs on Shopify.

7. Intellectual property

Site content, branding, logos, and designs are owned by us or our licensors. You may not copy, scrape, or reuse site content for commercial purposes without permission.

Product images and trademarks of artists, labels, or brands belong to their respective owners and are used for identification of goods offered for sale.

8. Prohibited uses

You agree not to:

Use the site for unlawful purposes
Attempt to interfere with site security or operations
Use bots or automated means to abuse checkout, inventory, or pricing
Submit false or misleading order information

9. Disclaimer of warranties

Except as required by law, the site and products are provided “as is.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law. Condition descriptions for used or collectible goods are not warranties beyond what is expressly stated.

10. Limitation of liability

To the fullest extent permitted by law, BJSD Solutions, LLC dba Spin and Sell and its owners, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the site or products.

Our total liability for any claim related to an order will not exceed the amount you paid for that order.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the site, violation of these Terms, or violation of any law or third-party right.

12. Privacy

Our Privacy policy explains how we collect and use personal information.

13. Governing law

These Terms are governed by the laws of the State of Pennsylvania, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Pennsylvania, unless applicable law requires otherwise.

14. Changes

We may update these Terms by posting a revised version on this page with a new “Last updated” date. Continued use of the site after changes constitutes acceptance.
